2. Definitions

- Usernames, passwords, and login credentials when you register for online services.

click-throughs, and referral source.

analyse usage and for marketing/analytics.

14. Risk Disclosure – Yoga Practice
To protect both you (the Participant) and the Studio, and to clarify responsibilities, please note the following:
14.1 Nature of Yoga Practice
- Yoga involves physical postures (asanas), breathing techniques (pranayama), meditation, relaxation and sometimes hands-on adjustments or use of props.
- While yoga offers many health benefits, it also carries **risks** if not practiced properly, especially for individuals with certain medical conditions, injuries, or who are pregnant, post-surgery or under medical care.
- By participating, you acknowledge that yoga may present **risk of injury or aggravation of existing conditions** if the postures, breathing or movement are not performed correctly, or if adequate supervision and attention is not maintained.
- You agree that you will exercise due care, listen to your body, follow instructor guidance, and promptly inform your instructor of any discomfort, pain or unusual symptoms.
14.2 Medical Disclosure & Assessment
- Prior to participation in any class, you are required to **complete a Health/Medical History Form honestly and in full**, disclosing all pertinent issues (past surgeries, injuries, chronic illness, medication, pregnancy, high/low blood pressure, heart conditions, joint problems, etc.).
- You represent and warrant that (i) you are in suitable physical and mental condition to participate in the class, (ii) you have consulted your medical practitioner if required, and (iii) you will **not hold the Studio responsible** for any injury, death, loss or damage whatsoever if you failed to disclose relevant medical history or if you push yourself beyond your capability.
- We **reserve the right to refuse or limit your participation** if we in our professional judgment believe it is unsafe for you to proceed without further medical clearance.
14.3 Assumption of Risk & Release
- You **accept all responsibility and risk** for your participation in Classes. You assume full responsibility for any injury, death, damage or loss that you may suffer or cause (including to property) arising from your participation.
- To the fullest extent permitted by law, you **release, waive, discharge and hold harmless** the Studio, its owner(s), instructors, employees, agents and affiliates from any liability, claims, demands, causes of action, or damages arising out of or related to your participation in Classes, whether caused by the negligence of the Studio or otherwise.
- This release includes, but is not limited to, claims for personal injury, property damage or wrongful death.
- You agree that this section of the policy **survives your participation** and continues indefinitely.
14.4 Instructor Guidance & Limitations
- Our instructors will provide guidance and supervision appropriate to the class level and their qualification, but you understand that **instructor guidance cannot guarantee complete avoidance of injury**.
- You agree to follow the instructor’s directions and **notify them immediately** if you feel unwell, faint, dizzy or unable to continue safely.
- If you are pregnant, have recently given birth, have a serious medical condition, or are recuperating from surgery or injury, you must inform the Studio and your instructor before the class. In many such cases we may require a **medical clearance certificate** from your doctor.
14.5 Use of Props, Equipment & Photographs/Video
- You understand that use of mats, props, blocks, straps or other equipment involves some risk, and you agree to **use them responsibly** and follow instructor guidance.
- You **consent to photographs or video recordings** of classes for the Studio’s promotional, monitoring or educational use. If you do not wish to be captured or used, you must notify us in writing in advance.
14.6 Indemnity
You agree to **indemnify and hold harmless** the Studio, its owner(s), instructors, employees, agents and affiliates from any loss, liability, claim, damage or cost (including legal fees) they may incur due to your negligence, breach of this policy, your failure to disclose medical history, or your violation of class instructions or rules.
14.7 Termination of Participation
- The Studio **reserves the right to decline or terminate your participation** in any class at its sole discretion (for example, if you fail to disclose required medical history, behave inappropriately, pose a safety risk, or ignore instructor guidance).
- If participation is terminated for safety reasons, **no refund or compensation is automatically guaranteed** (unless otherwise stated in the Studio’s class terms).
14.8 No Medical or Therapeutic Warranty
- The Studio’s classes, instructor comments, website materials, videos or communications are for general wellness, fitness and educational purposes only, and **do not constitute medical advice, diagnosis or treatment** of any condition.
- You should seek professional medical advice if you have or suspect you have a medical condition. The Studio **does not warrant** that classes will prevent injury, improve health or provide therapeutic results.
14.9 Intellectual Property & Class Materials
- All class materials (written, audio, video), website content, logos, trademarks are **owned by the Studio** or its licensors. You may not reproduce, distribute, publicly display or create derivative works without written permission.
- Use of any materials is at your own risk; the Studio is **not responsible** for your misuse of class videos or recorded content outside the supervised class environment.
15. Miscellaneous
Governing Law & Jurisdiction
This Policy & Waiver shall be governed by and construed in accordance with the laws of **India** and the courts of **[City/State]** shall have exclusive jurisdiction.
Severability
If any provision hereof is held **invalid or unenforceable**, the remaining provisions shall remain in full force and effect.
